Area Overview
Niles Charter Township surrounds the City of Niles in the southeast corner of Berrien County, bordering Indiana and the St. Joseph River. Housing stock is primarily detached single-family homes on both municipal water/sewer and private well/septic, with a mix of rural-residential, suburban, and agricultural parcels; portions of the Pokagon Band of Potawatomi Indians' reservation (Rodgers Lake area) fall within township boundaries but are federal trust land outside township zoning authority.
The township has an explicit short-term rental ordinance (Zoning Ordinance Section 3.11, adopted May 2023) that permits STRs only in specific residential districts and requires an annual Zoning Compliance Permit [1]. There is no separate long-term rental registration ordinance in Niles Charter Township โ LTRs operate under Michigan state landlord-tenant law and standard residential zoning.
Quick Status Summary
STRs are permitted only in single-family dwellings in the AP, RP, R-1A, and R-1B zoning districts, under Zoning Ordinance Section 3.11 [1]. Owner must obtain an annual Zoning Compliance Permit before advertising or operating. If the owner lives more than 20 miles from the property, a local agent must be designated who can be physically on-site within 60 minutes. Annual fee is set by Township Board resolution.
Long-term rentals (31 days or longer) are permitted in residential zoning districts with no township-specific registration or licensing requirement. Landlord-tenant relationships are governed by Michigan state law (MCL 554.601 et seq.). Always confirm parcel-level zoning for any specific property.
Rental Regulations
Where STRs Are Allowed (Zoning)
Short-term rentals are permitted only in single-family dwellings in four zoning districts: AP (Agricultural Preservation), RP (Rural Preservation), R-1A, and R-1B. They are not permitted in any other residential, commercial, industrial, or mixed-use district. This is codified in Zoning Ordinance Section 3.11.B [1].
Short-term rental is defined in Section 3.11 as the rental of a single-family dwelling for compensation for not more than one month at a time [1]. Multi-family dwellings, duplexes, and accessory dwelling units are not eligible.

Registration & Permit Process
Submit a completed Short Term Rental Application by mail or in person to the Township Hall at 320 Bell Road, Niles, MI 49120. The application is the governing document under Section 3.11.C and must be filed annually before advertising or operating [1].
Fees & Penalties
The annual STR permit fee in Niles Charter Township is set by Township Board resolution, not in the ordinance itself. The Zoning Ordinance text says only: “The property owner shall pay an annual fee, the amount of which shall be established by resolution of the Township Board” (Section 3.11.C) [1].

Operating Rules — Occupancy, Parking, Safety
Section 3.11.E of the Zoning Ordinance imposes the following performance standards on every permitted STR [1]:
- Maximum occupancy is capped by the adopted International Property Maintenance Code. Campers, tents, accessory dwellings, couches, and floor sleeping are prohibited as additional occupancy.
- Single-party rental only. The dwelling cannot be rented to more than one party simultaneously.
- Parking: minimum two (2) off-street spaces on the subject property for up to six renters, plus one additional space for every three renters over six. Parking on grass, street right-of-way, or the street itself is prohibited.
- Smoke & CO alarms: every bedroom must have a working smoke alarm; every floor must have a working CO detector; owner or local agent must verify these at least every 90 days (Section 3.11.C.1.d) [1].
- No on-premise signage advertising the STR is allowed; the dwelling’s exterior must retain residential character.
- Posted notice inside the unit: the STR permit, Section 3.11 ordinance text, owner/local agent contact, Township emergency contact, and the property street address must be posted conspicuously. The street address must also be posted on every occupied floor, including the basement.
- Visible street number from the road is required.
Local Agent & 24-Hour Contact Requirement
If the property owner does not live within 20 miles of the STR, a local agent must be named on the permit application. The owner or local agent must be (a) available 24/7 to accept phone calls and other communication while the unit is rented, and (b) able to be physically on-site within 60 minutes when contacted by the Township, a Township designee, or law enforcement (Section 3.11.D) [1].
A substitute person may cover the same 60-minute response window if arrangements are documented.
Enforcement, Inspections & Violations
The Township may inspect an STR with a minimum of 24 hours’ advance notice (or sooner in an emergency) to verify compliance with the ordinance. Owners certify consent to this inspection regime on the permit application (Section 3.11.C.1.d.2) [1].
- Initial / renewal inspection: triggered by application. Additional re-inspection visits may incur additional fees set by Township Board resolution.
- Complaint handling: owner or local agent must act on notice of renter violations (noise, trash, parking, etc.) and take steps to prevent recurrence (Section 3.11.E.6) [1].

Where LTRs Are Allowed (Zoning)
Long-term rentals (leases of more than one month) are permitted in any zoning district where residential dwelling use is permitted by right. Niles Charter Township does not impose a separate long-term rental licensing or registration scheme — Section 3.11 of the Zoning Ordinance applies only to rentals of one month or less [1].
In practice, this means any single-family or multi-family home in an AP, RP, R-1A, R-1B, R-2, or R-3 district that is legally used as a dwelling can also be rented out as a long-term rental. For agricultural, commercial, or mixed-use zoned properties, verify that the underlying residential use is permitted (or grandfathered) before assuming LTR is viable.
Registration & Permit Process
Niles Charter Township has no local long-term rental registration, licensing, or inspection program. There is no township form to file and no township fee to pay for an LTR (lease longer than one month) [1].
This is different from neighboring jurisdictions: the City of Niles, Bridgman, Saint Joseph, and Stevensville all run rental registration programs. A property investor whose portfolio spans the City of Niles and Niles Charter Township should not assume the City’s rental license rules carry over into the Township — they do not.
Building, Zoning & Property Maintenance
Even without an LTR license, a landlord in Niles Charter Township must still meet these baseline Township and state requirements before or during a tenancy:
- Zoning compliance for residential use. Confirm the parcel’s zoning district permits dwelling use by right; required when adding a second unit, an accessory dwelling, or changing use category.
- Building permits for renovation work. Electrical, plumbing, mechanical, and structural changes require permits through the Township Building Department before work begins.
- International Property Maintenance Code. The Township has adopted the IPMC by reference for baseline habitability standards; the Section 3.11 STR occupancy cap is pegged to IPMC, and the same code informs LTR habitability as well.
- Septic & well (if not on municipal utilities). Berrien County Health Department inspects and permits private septic and well systems; request Time-of-Sale inspection records before closing on a property.
