Area Overview
Silver Creek Township sits in the northwest corner of Cass County, bordering Berrien County to the west and Van Buren County to the north. The township is largely rural and agricultural, but its northwest corner anchors the Sister Lakes resort area โ Magician Lake, Dewey Lake, Round Lake, and Big and Little Crooked Lakes โ a long-established second-home and short-stay rental market drawing visitors primarily from northern Indiana and the Chicago metro.
Short-term rentals are now governed by Ordinance 25-01, adopted March 19, 2025 and effective April 28, 2025 [1]. The ordinance caps active STR registrations at 500 township-wide on a first-come, first-served basis, restricts rental terms to between 3 and 28 days (with a 180-day-per-year cap), and limits the program to single-family dwellings only โ two-family dwellings, RVs, motorhomes, tents, and accessory structures cannot be rented short-term [1]. Long-term rentals are not separately registered at the township level; they fall under standard residential zoning and Michigan’s statewide landlord-tenant framework.
Quick Status Summary

Long-term rentals (29+ day leases) are permitted in standard residential zoning districts under the Silver Creek Township Zoning Ordinance [5]. The township does NOT operate a separate LTR registration or inspection program โ leases of 29+ days fall outside Ordinance 25-01’s STR scope [1] and are governed by Michigan landlord-tenant law [9].
Rental Regulations
Where STRs Are Allowed (Zoning)
STRs are permitted township-wide under Ordinance 25-01, but ONLY in single-family dwellings. Two-family dwellings, tents, recreational vehicles, motorhomes, vehicles, and accessory structures cannot be used as short-term rentals [1].
Beyond the single-family-dwelling rule, STRs must comply with the underlying Silver Creek Township Zoning Ordinance (Chapter 155) [5]. Registration & Permit Process
STR applications are submitted to the Zoning Administrator (Ryan Laylin) using the township’s STR Application Packet [10]. There is no online STR portal โ forms are returned in person or by mail to 32764 Dixon Street, Dowagiac, MI 49047 [4].
Fees & Penalties
STR fines are set by ordinance and tiered by violation type [1]. The annual STR registration fee is set by Township Board resolution and is not currently published on the township website โ confirm the current amount with the Zoning Administrator before submitting an application.
Each day a violation continues counts as a separate violation. Two separate-day responsible determinations within a calendar year can trigger registration revocation [1].
Inspections & Safety Requirements
Owners must consent to and schedule inspections on request of the Building Official, Code Enforcement Officer, law enforcement, or another designated official [1]. If the dwelling is not on public sewer, the CassโVan Buren District Health Department must inspect the septic system and issue a certificate confirming it is in good working order; that inspection is required every three (3) years [1] [7]. Porta-potties / temporary bathrooms are explicitly prohibited [1].
Required by Ordinance 25-01 [1]:
- Smoke detectors per Michigan Residential Code: one in each bedroom, one on each habitable floor, and one in the basement.
- Carbon-monoxide detector on each floor (operational, approved per Michigan Residential Code).
- Fire extinguisher in the kitchen (operational).
- Green reflective street-address placard visible from the road.
- Street address posted inside in at least two prominent locations โ in the kitchen and near any telephone or pool.
- $1,000,000 liability insurance as a rental property, maintained throughout the registration period (the township must be notified within 24 hours if coverage lapses).
Attics, basements, garages, accessory buildings, and porches do not count as habitable space for occupancy purposes unless they meet Michigan Property Maintenance Code / construction-code egress requirements [1].
Operating Rules (Occupancy, Quiet Hours, Parking)
Maximum occupancy is the lesser of (a) 10 total occupants OR (b) 2 occupants per bedroom plus 1 additional occupant per finished story that meets egress requirements [1]. Daytime guests are allowed between 8 AM and midnight, and the total people on site (occupants + day guests) cannot exceed 2x the maximum occupancy [1].
- Quiet hours: 12 AM to 8 AM. Yelling, shouting, singing, and outdoor music that unreasonably disturbs others are prohibited at any time [1].
- Rental term: Minimum 3 days, maximum 28 consecutive days; only one rental term may begin during any calendar week; no more than 180 rental days per calendar year per dwelling [1].
- Parking: Tenants must park only in approved off-street spaces. Parking on grass, public or private roads, road right-of-way, or land owned by someone else is prohibited โ violators will be towed at their own expense [1].
- Trash: Adequate, closed containers required. Trash must be disposed of on a regular weekly schedule and kept secured from animals [1].
- Signs: No exterior sign may be used to advertise the dwelling as a short-term rental [1].
- Land-based recreation, pets, campfires: All recreation and pets must stay on the rented premises (no encroaching on neighbors). Campfires only in designated fire pits, attended at all times, and subject to State or local burn bans [1].
- Boats / lake access: If a boat or vessel is rented separately or included with the dwelling rental, a Livery License is required under MCL 324.44516 [1].
- Fireworks: Must comply with the Michigan Fireworks Safety Act (Act 256 of 2011, as amended) [1].
Owners must provide renters with copies of the township’s STR rules, trash/parking/occupancy/day-guest limits, quiet-hours rule, and good-neighbor policy [1]. Those rules and the local-agent contact info must also be posted in the rental property [1].
Local Agent / 24-Hour Contact Requirement
The owner, a local agent, or the designee of either must respond within 30 minutes of being contacted by the Township or law enforcement about an issue at the property [1]. The responding agent must possess keys to access all buildings on the property and must have authority to make decisions about the issue at hand [1].

Permit Caps, Moratoriums & Recent Changes
Silver Creek Township stood up its first dedicated short-term rental ordinance in 2025 after several years of planning-commission discussion.
- March 19, 2025: Township Board adopted Ordinance 25-01 unanimously [1].
- April 28, 2025: Ordinance took effect (30 days after publication) [1].
- June 1, 2025: Initial registration deadline. Owners renting or advertising a short-term rental after June 1 without having registered are subject to an increased late-registration fee set by Board resolution [1].
- 500-unit cap. No more than 500 STRs may be registered township-wide in any calendar year. Applications are first-come, first-served and date- and time-stamped; once the cap is reached, additional applications for that year are denied [1]. The township does not publish the current count online โ confirm availability with the Zoning Administrator before underwriting an STR-based purchase.
- Annual renewal: Owners must re-register for each calendar year, providing the registration information at least 30 days before license expiration [1].
- Non-transferable. Registrations do NOT convey with a property sale โ new owners must reapply, subject to cap availability [1].
- Single-family only. Two-family dwellings, RVs, motorhomes, vehicles, tents, and other structures cannot be used as STRs under any circumstance [1].
Where LTRs Are Allowed (Zoning)
Long-term rentals (lease terms of 29 days or more) follow the underlying Silver Creek Township Zoning Ordinance (Chapter 155) [5]. If a parcel is zoned for residential dwelling use, LTRs are permitted โ there is no separate “Commercial Lodging” classification because that category does not exist in Silver Creek’s code; the only rental category the township regulates separately is the Short-Term Rental of single-family dwellings under Ordinance 25-01 [1].
LTRs are not subject to the 500-unit cap that applies to short-term rentals โ a lease term of 29 or more days falls outside Ordinance 25-01’s scope (which defines an STR as 3โ28 days) [1].

Registration & Permit Process
Silver Creek Township does not operate a separate long-term rental registration program. Lease terms of 29 days or more are not covered by Ordinance 25-01 [1], and there is no LTR-specific application packet on the township’s Forms, Permits, and Resources page [2]. Standard residential zoning compliance and Michigan landlord-tenant law apply [9].
Practical steps for an LTR investor:
- Confirm the parcel’s zoning permits residential dwelling use โ contact the Zoning Administrator (zoning@silvercreektwpmi.gov) [4].
- Pull a building permit for any renovations, conversions, or change-of-use through the township’s online portal at BS&A Online or via the paper Building Permit Application [2].
- Verify septic capacity for the intended occupancy โ the Cass-Van Buren District Health Department issues home-loan and inspection-only septic evaluations [7].
Fees & Penalties
There are no township-level long-term-rental registration fees or LTR-specific penalties in Silver Creek Township [2]. Permit costs that an LTR landlord may encounter are limited to general building, zoning, and trade-permit fees if work is done on the property:
Standard Michigan landlord-tenant remedies (security-deposit penalties, summary-proceedings filing fees, etc.) are governed by state law, not the township [9].
Inspections & Safety Requirements
There is no routine township inspection cycle for long-term rentals in Silver Creek. LTR units must comply with the Michigan Residential Code and the International Property Maintenance Code (adopted as part of the State Construction Code) [1]. The township’s Building Official inspects construction work pulled under building, electrical, mechanical, or plumbing permits, but does not separately re-inspect existing LTR units [3].
Recommended baseline for an LTR landlord:
- Operational smoke detectors in each bedroom, on each habitable floor, and in the basement (matches Michigan Residential Code) [1].
- Operational carbon-monoxide detectors on each floor [1].
- Properly maintained well and septic. The CassโVan Buren District Health Department offers home-loan well/septic inspections โ strongly recommended before purchase of a non-public-sewer property [7].
- Verify there are no open or expired building permits at closing (BS&A Online lookup) [2].
Tenant Rights & Eviction Resources
Michigan landlord-tenant relationships are governed by state law (MCL 554.601 et seq.) and the summary-proceedings act for evictions โ not by Silver Creek Township ordinance. $1,000,000 STR Liability-Insurance Requirement
Every Single-Family Dwelling registered as an STR must carry rental-property liability insurance with a minimum $1,000,000 policy limit, maintained continuously throughout the registration period [1]. Proof of coverage is required at registration; if coverage lapses for any reason, the township must be notified within 24 hours [1].
This is materially higher than most rental insurance baselines and should be priced into the underwriting on any Silver Creek STR pro forma. Confirm with your insurance carrier that a vacation/STR endorsement is in place rather than a standard homeowner or landlord policy.
Septic Inspection Cycle (Cass-Van Buren Health Department)
Silver Creek STRs not connected to public sewer must obtain a Cass-Van Buren District Health Department septic certificate showing the system is in good working order, with re-inspection every three (3) years [1] [7]. Porta-potties and other temporary bathroom facilities are explicitly prohibited [1].
Septic capacity also constrains maximum occupancy: a system designed for a three-bedroom home can fail under STR-style intensified use even if the home physically has capacity for more. Buyers of any non-sewered Sister Lakes property should request the most recent inspection records and a current capacity evaluation from the health department before closing [7].
